Terms & Conditions
1.1 The present terms and conditions (the “Terms” ) are applicable for all legal relations, products ("the Products") offers, sales and deliveries between the customers (hereinafter also referred to as “You”) and helenvalk.com run by HVV Disain OÜ ( the “Web store” ), reg. code 11943503, registered address Arukase 6, Tartu 51011, Estonia.
1.2 In addition to the present terms and conditions, the legal relations arising as a result of purchasing the Products from the Web store are regulated by applicable legislative acts of Estonian Republic.
1.3 Web store has the right to change the present terms and conditions. All the changes will be published online on helenvalk.com website and will come into effect immediately after their publication. Using the site or by placing an order the customers agree to be bound by present terms and conditions.
2. Prices
2.1 Prices in the Web store are stated in euro (€) and include Estonian Value Added Tax (20%).
2.2 The prices don’t include the shipping costs. Shipping costs are specified in the order sum at Checkout for the customers to review before confirming the order.
2.3 If the customer order Products for delivery outside of the EU please note that the customer’s purchase may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by the customer.
2.4 Web store price list is valid for timely paid invoices. Web store has the right to change the prices indicated on website. All the changes will be published online on helenvalk.com website and will come into effect immediately after their publication.
2.5 Should the order be placed before the price change have occurred, the customer is obligated to pay the price which were in force at the time of placing the order.
3. Purchase and payment terms
3.1 In order to purchase a product from the Web store, please select the product and click “Add to cart“ button. When you click the button “Shopping Cart” then you can see the items in your cart, change the amount and remove them. You can also see the shipping cost and total amount (with VAT).
3.2 When confirming the order enter your name, e-mail address, name of the Company (when the invoice is to a company), shipping address and phone number. Please double-check the billing and shipping information, since quick and uninterrupted delivery of your order depends on the accuracy of the info submitted. After confirming the order Web store will send You a e-mail to specify the details of the ordered Product if necessary.
3.3 In order to make payment you can use Direct Bank Link (Estonia only), Visa/ MasterCard, Bank Transfer or PayPal. The total amount will be paid when confirming the purchase.
3.4 Payment by direct bank link and Visa or MasterCard are services provided by Maksekeskus AS.
3.5 The responsible processor of clients’ data HVV Disain OÜ will forward the necessary data of the client to Maksekeskus AS to process Direct Bank Link payments and Visa/ MasterCard payments.3.6. The contract enters into force the moment the payment is transferred to HVV Disain OÜ bank account.
4. Shipping
4.1 Web store purchase valued under 150 euros ship worldwide with regular registered air mail. Once your order is shipped we will let you know and send you the tracking code. Web store purchases valued over 150 euros ship with DHL Express.
4.2 The products are made to order. Bras, panties, suspender belts and lingerie sets are ready to ship in 5 business days. Loungewear and clothing ships out in 1-2 weeks.
4.3 Air mail shipping can take up to 10 business days for European countries and 20 business days to everywhere else. DHL Express shipping takes 1-3 business days in Europe, 3-5 business days worldwide. Please contact us in case you haven't received your parcel in that timeframe.
4.4 Web store is not responsible for the delivery delays or problems that are due to the incorrect entering of the shipping address by the client.
5. Returns & Refunds
5.1 Please contact us immediately helen@helenvalk.com, if you have any issues with the purchased goods. We can offer returns and refunds or exchanges to clothing and loungewear items. Due to the intimate nature of lingerie items, we cannot accept returns for bras and panties, because of hygiene concerns. We handle customer concerns on a case to case basis, so please do not hesitate to contact us.
5.2 The Product must be sent back in their original package and condition. You have to ensure that the Product being returned is unused and in perfect condition. Please note that unused means that there are no marks or damage on the item. Web store will not accept Products with any indication that it was used. In such cases, the Products will be returned to the customer.
5.3 When returning the Product as specified in Clause 5.1 and 5.2 the Web store will return the sum paid for the order including shipping fees . The due sum is to be transferred to the customer's bank account in 14 days after receiving the client's return returned item.
5.4 If you discover a defect of any kind in a Product delivered by us, please contact us immediately. This will entitle you to a replacement Product or, in cases where this is not possible, a refund. If the product delivered is wrong or damaged we will arrange the free return. Sellers of consumer goods within the EU are obliged to guarantee the conformity of the goods with a contract, for a period of two years after the delivery of the goods.
5.5 Web store reserves the right to cancel the contract when it is not possible to deliver the Products the customer ordered or one or more products the customer ordered was listed at an incorrect price due to a typographical error. If we cancel the contract we will notify you by e-mail and will re-credit to your account the sum deducted by us from your credit card as soon as possible but no later than within 30 days since you placed the order.
6. Copyright
6.1 All the content available on the Web store, including, but not limited to, text, graphics, logos, images, video and audio clips (the "Content") is the property of the Web store and is protected by Estonian and international copyright laws.
6.2 It is not allowed to use, reproduce, duplicate, copy, sell, modify, or otherwise exploit the Content in full or in part, for any purpose without linking the original source.
7. Liability and Force Majeure
7.1 The Web store and the customer are mutually liable for any damage caused to another party by not complying to the present terms in amount and in cases provided for by the applicable European Union legislative acts unless the damage incurred is caused by circumstances beyond the control and could not have possibly foreseen (Force Majeure).
7.2 The Web store liability connected to any products acquired through the Web Store is strictly limited to the buying price of the products.
7.3 Any links to other websites which are not operated by the Web store is out of our control and we accept no responsibility for them.
8. Governing Law
8.1 All matters not covered by the present terms are to be resolved based on the applicable legislative acts of Estonian Republic.
8.2 All the disputes between the customers and HVV Disain OÜ regarding ordering and buying products from the Web store are to be resolved by negotiations. Should the compromise not be reached, the Parties have the right to turn to Customer Protection Department or Tartu Maakohus (Tartu County Court) in order to protect their rights.
